This Cancellation & Refund Policy ("Policy") forms an integral part of the Terms of Use of Nowory Labs Private Limited ("Company", "Platform", "We", "Us", or "Our"). By accessing or using the Platform, you acknowledge that you have read, understood, and agreed to this Policy.

1. Policy Statement

Due to the irreversible nature of blockchain technology and digital asset transactions, the Company does not permit the cancellation or refund of any order that has been successfully executed, whether fully or partially.

Once a buy or sell order is matched on the Platform, the corresponding assets and/or funds are transferred between users through the Platform's matching engine, and such transactions cannot be cancelled, modified, or reversed.

Users are advised to carefully review all order details before placing any transaction.

2. Cancellation of Orders

2.1 Open Orders

A user may cancel an order only if it has not been matched or executed.

Upon cancellation:

  • The remaining blocked balance shall be released to the user's account.
  • No cancellation fee shall be charged unless otherwise specified by the Platform.

2.2 Partially Executed Orders

Where an order has been partially executed:

  • The executed portion shall remain final and irreversible.
  • Only the unexecuted balance of the order may be cancelled.

2.3 Fully Executed Orders

Once an order has been fully executed:

  • It shall be deemed final.
  • No cancellation, refund, reversal, or modification shall be permitted.

3. Refund Policy

The Company does not provide refunds for completed cryptocurrency trades.

Refund requests shall not be accepted merely because:

  • Cryptocurrency prices have changed.
  • The user incurred trading losses.
  • The user changed their investment decision.
  • The user placed an incorrect order.
  • The user misunderstood the market.

4. Cryptocurrency Deposits & Withdrawals

Blockchain transactions are irreversible.

Accordingly, once a cryptocurrency withdrawal has been signed, broadcast, or confirmed on the blockchain network, it cannot be cancelled or recalled.

Users are solely responsible for verifying:

  • Wallet address.
  • Blockchain network.
  • Destination wallet compatibility.
  • Memo/tag (where applicable).
  • Token type.

The Company shall not be liable for any loss resulting from incorrect information provided by the user.

5. INR Deposits & Withdrawals

Where INR deposits are successfully received by the Company but remain uncredited due to technical or operational reasons, the Company may, after verification:

  • Credit the amount to the user's account or
  • Refund the amount to the original source account, wherever applicable.

Users may request cancellation of an INR withdrawal only while the withdrawal request remains in a pending state

Once the withdrawal has been processed through banking channels, it cannot be cancelled.

6. Platform Errors

The Company reserves the right to suspend, cancel, reject, reverse (where technically possible), or otherwise rectify any transaction where it reasonably believes that:

  • A technical malfunction has occurred.
  • An incorrect market price was displayed.
  • Duplicate execution has taken place.
  • A system error affected the transaction.
  • Unauthorized access has been detected.
  • Fraud or market manipulation is suspected.
  • Regulatory directions require intervention.

The Company shall make reasonable efforts to restore affected users to the position they would have been in had the error not occurred, subject to applicable law and technical feasibility.

7. Fraud, Compliance & Regulatory Restrictions

The Company may refuse, suspend, delay, or reject any transaction where:

  • KYC verification remains incomplete.
  • AML/CFT screening raises concerns.
  • Suspicious transaction monitoring generates alerts.
  • Payment source verification fails.
  • Sanctions screening identifies a restricted individual or entity.
  • Regulatory authorities issue directions affecting the transaction.
  • The transaction appears fraudulent or unlawful.

The Company may retain or freeze funds where required under applicable law.

8. Deductions & Set-Off

The Company reserves the right to deduct or recover from the user's account any amount lawfully payable to the Company, including but not limited to:

  • Trading fees.
  • Withdrawal charges.
  • Taxes.
  • Statutory deductions.
  • Chargebacks.
  • Penalties.
  • Amounts arising from operational errors.
  • Other legitimate dues.

After such deductions, the remaining balance, if any, may be made available to the user in accordance with applicable laws and the Company's internal procedures.

9. Circumstances Where Refunds Shall Not Be Available

Refunds shall not be available in circumstances including, but not limited to:

  • Executed buy or sell orders.
  • Market volatility or price fluctuations.
  • Incorrect wallet address.
  • Incorrect blockchain network selection.
  • Unsupported wallet usage.
  • User negligence or error.
  • Forgotten memo/tag.
  • Unauthorized access caused by compromise of the user's credentials.
  • Delays caused by blockchain congestion.
  • Failure to complete KYC requirements.
  • Suspected fraud or illegal activity.
  • Compliance-related restrictions.

These providers have their own privacy policies.

10. Exceptional Refunds

The Company may, at its sole discretion, process refunds only in exceptional situations including:

  • Duplicate INR deposits.
  • Duplicate payment processing.
  • Failed settlement due to a technical issue.
  • Accidental over-credit caused by a system malfunction.

Such refunds shall be subject to internal verification, compliance review, and applicable legal requirements.

11. Processing Timeline

Where a refund is approved under this Policy, the Company shall endeavour to process the refund within 5 to 10 Business Days, subject to:

  • Banking partner timelines.
  • Payment gateway processing.
  • Compliance verification.
  • Regulatory requirements.

Processing timelines are indicative and may vary.

12. Force Majeure

The Company shall not be responsible for delays or inability to process cancellations, refunds, or withdrawals arising from events beyond its reasonable control, including but not limited to:

  • Blockchain congestion.
  • Network forks.
  • Cyber incidents.
  • Banking failures.
  • Payment gateway disruptions.
  • Internet outages.
  • Governmental actions.
  • Natural disasters.
  • War, terrorism, or civil disturbances.

13. Amendments

The Company reserves the right to amend, modify, or replace this Policy at any time.

Any revised version shall become effective upon publication on the Platform unless otherwise specified.

14. Governing Law

This policy shall be governed by and construed in accordance with the laws of India.

Any dispute arising under this Policy shall be subject to the exclusive jurisdiction of the competent courts located at Kanpur Uttar Pradesh, India, unless otherwise required by applicable law.
